  • 5/14/04: FINAL JUDGMENT AND ORDER filed by Judge Marsha J. Pechman, dismissing with prejudice as to Defendant Homestore, Inc. The Court finally approved and confirmed the settlement in favor of Homestore Inc as set forth in the STIPULATION and found that said settlement is, in all respects, fair, reasonable and adequate to the class pursuant to FRCP 23; the Homestore Parties were released and discharged with respect to any and all claims or causes of action which the Lead Plaintiff and Members of the Class had or have arising out of or related to any of the Settled Claims as defined in the stipulation; and found that the Final Judgment should be entered and further found that there was no just reason for delay in the entry of the Judgment, as a final judgment as to the parties to the STIPULATION.
  • 4/29/04: STIPULATION AND ORDER filed by Judge Marsha J. Pechman ordering that the case and common stock portion of the Settlement Fund shall be placed in trust with Cotchett, Pitre, Simon & McCarthy, Lead Counsel, as Trustee. Bear Stearns shall act as Custodian of the common stock portion of the Settlement Fund. The Custodian and Trustee shall be responsible for maintaining the common stock consistent with the Stipulation and their obligations imposed by law. The Custodian, Bear Sterns, shall not bear the risk of declines in the market price of the common stock pending distribution to the Class.
  • 3/16/04: ORDER granting motion for final approval of partial class settlement and directing renotice of the Class issued by Judge Marsha J. Pechman. See ORDER.

  • 2/5/04:  Judge Marsha J. Pechman issued an ORDER directing further briefing on Motion for final approval of partial class settlement.  The Court directed the parties to the settlement, lead plaintiff and defendant Homestore, to submit further briefing of no longer than 10 pages to the Court no later than 10 judicial days after issuance of this order. See ORDER.
